Kill the 1 to save the 9... children do not always make the best life choices, so to say they 'deserve' it if they are playing on the live tracks..... it is not right in my book.
Why are the children on the tracks in the first place? Stories like that never end well for anyone.
Kill the one child. Less lawsuits in the end. Even though the children would be at fault (The nine), the parents would still nail you with fees etc.

this is a good scenario, but i would save the most lives, unless theres lets say, 4 children on one side and 8 old people (80-ish) on the other side, i would save the children. they have a long life ahead of them.
Just to be a pain, if the train driver had time to switch tracks, surely he has time not only to hit the breaks but also enough time for the train to stop or slow down so much that the kids notice and move? Sorry xD
He should drive the train off the tracks and kill himself because he is older than them and they have more life ahead of them.
with all the poverty, war, crime, corruption and selfishness that is going on in the world atm, i'd time the track switch so that the front weels would slide on the new rail and the back weels would slide on the old rail and get the bloody lot of them.
The train driver applies the brakes, no speed or distance away was specified, therefore the train driver might be driving slow enough to stop, or the train might be too far away so the children know its coming.
Instead of being a smart arse, I'm not sure what to choose.
